These Terms of Service govern your use of Bristol Maps, our website located at https://bristolmaps.com, and any related services provided by Bristol Maps.
When you use Bristol Maps, you agree to abide by these Terms of Service and to comply with all applicable laws and regulations. If you do not agree with these Terms of Service, you are prohibited from further using the app, accessing our website, or using any other services provided by Bristol Maps.
If you access or download Bristol Maps from (1) the Apple App Store, you agree to any Usage Rules set forth in the App Store Terms of Service; and/or (2) the Google Play Store, you agree to the Android, Google Inc. Terms and Conditions including the Google Apps Terms of Service.
We, Bristol Maps, reserve the right to review and amend any of these Terms of Service at our sole discretion. Upon doing so, we will update this page and notify you through the app and/or the email address you provided when you created your account. Any changes to these Terms of Service will take effect immediately from the date of publication.

Limitations of Use
By using Bristol Maps and our website, you warrant on behalf of yourself, any entity who you represent who has entered into these Terms of Service, and your users that you will not:
- modify, copy, prepare derivative works of, decompile, or reverse engineer Bristol Maps or any materials and software contained within Bristol Maps or on our website;
- remove any copyright or other proprietary notations from Bristol Maps or any materials and software contained within Bristol Maps or on our website;
- transfer Bristol Maps or any of its associated materials to another person or "mirror" the materials on any other server;
- knowingly or negligently use Bristol Maps or any of its associated services in a way that abuses or disrupts our networks or any other service Bristol Maps provides;
- use Bristol Maps or its associated services to transmit or publish any harassing, indecent, obscene, fraudulent, or unlawful material;
- use Bristol Maps or its associated services in violation of any applicable laws or regulations;
- use Bristol Maps to send unauthorized advertising or spam;
- harvest, collect, or gather user data without the user's consent; or
- use Bristol Maps or its associated services in such a way that may infringe the privacy, intellectual property rights, or other rights of third parties.
Subscription and Pricing Terms
Subscription Services
Bristol Maps may offer subscription-based services through the App Store and Google Play Store. By selecting a subscription option, you agree to pay the subscription fees indicated at the time of purchase.
Billing and Auto-Renewal
- All subscriptions will automatically renew unless auto-renewal is turned off at least 24 hours before the end of the current subscription period
- Your account will be charged for renewal within 24 hours prior to the end of the current period
- You can manage and cancel your subscriptions by going to your account settings in the App Store or Google Play Store after purchase
Price Changes
We reserve the right to modify our subscription prices. Any price changes will comply with the following terms:
For iOS Users:
- You will receive notice of any price increase at least 30 days before it takes effect
- The price increase will only apply to your subscription after the end of your current subscription period
- You will be notified of the new price and have the opportunity to agree to the new price or cancel your subscription
- If you do not agree to the price increase, your subscription will not be renewed at the next billing period
For Android Users:
- You will be notified of any price increase at least 30 days before it takes effect
- The new price will only apply after your current subscription period ends
- If you do not accept the new price:
- For monthly subscriptions: Your subscription will continue at the current price until the end of the current billing period, then cancel
- For annual subscriptions: Your subscription will continue at the current price until the end of your annual billing period, then cancel
Promotional Offers and Trials
- Any promotional or trial prices are temporary
- After the promotional or trial period ends, your subscription will automatically renew at the standard subscription price
- The standard price will be shown to you when you sign up for the promotional or trial offer
Refunds
- All purchases are final and non-refundable, except as required by law
- Refund requests should be made through the App Store (for iOS users) or Google Play Store (for Android users)
- Bristol Maps does not directly process refunds for in-app purchases or subscriptions
Intellectual Property
The intellectual property in the materials in Bristol Maps and on our website are owned by or licensed to Bristol Maps. You may download Bristol Maps, to view, use, and display the application on your mobile device for your personal use only.
This constitutes the grant of a license, not a transfer of title. This license shall automatically terminate if you violate any of these restrictions or these Terms of Service, and may be terminated by Bristol Maps at any time.
User-Generated Content
You retain your intellectual property ownership rights over content you submit to us for publication within Bristol Maps and/or on its corresponding website. We will never claim ownership of your content, but we do require a license from you in order to use it.
When you use Bristol Maps or its associated services to post, upload, share, or otherwise transmit content covered by intellectual property rights, you grant to us a non-exclusive, royalty-free, transferable, sub-licensable, worldwide license to use, distribute, modify, run, copy, publicly display, translate, or otherwise create derivative works of your content in a manner that is consistent with your privacy preferences and our Privacy Policy.
Maritime Safety and Navigation Disclaimer
CRITICAL: Bristol Maps is a supplemental navigation tool and should NOT be used as a primary means of navigation. Users must:
- Maintain traditional navigation equipment and charts as required by maritime law
- Verify all navigational data independently
- Not rely solely on Bristol Maps for safety-critical decisions
- Understand that GPS accuracy can vary and map data may be outdated
- Comply with all USCG navigation requirements and regulations
Bristol Maps provides navigation information "as is" without warranty of accuracy. Depth soundings, boundary lines, hazard markers, and other navigational features are for reference only. Users are solely responsible for safe navigation of their vessels.
Real-Time Data and Third-Party Information
Bristol Maps provides access to various real-time and third-party data sources. You acknowledge and agree that:
- Weather forecasts are provided by Visual Crossing and NOAA and may be delayed or inaccurate
- Tide predictions are estimates and actual conditions may vary
- AIS vessel positions may be delayed, incomplete, or unavailable
- Fleet location sharing depends on network connectivity and user participation
- We are not responsible for decisions made based on this data
- Always verify critical information through official sources
Offline Map Data
Downloaded maps are static at the time of creation. Users are responsible for:
- Regularly updating map data
- Verifying regulatory boundaries match current regulations
- Understanding that offline maps may not reflect recent changes to hazards, boundaries, or navigational aids
Commercial Fishing Data and Fish Tickets
When you use Bristol Maps to create fish tickets, log catches, or submit delivery information:
- You represent that you have the right to share this information
- You understand this data may be shared with assigned tenders and processors
- You are responsible for compliance with Alaska Department of Fish & Game reporting requirements
- Bristol Maps does not validate fish ticket data for regulatory compliance
- You retain ownership of your fishing data, but grant us license to process and transmit it as needed for app functionality
Processor and Tender Integration
Bristol Maps facilitates integration between fishermen and fish processors/tenders. You acknowledge and agree that:
- Processors and tenders may share information about deliveries, freight, pricing, and other operational data through Bristol Maps
- Processors may see limited data associated with your user account, including but not limited to: your name, vessel information, delivery history, and contact information necessary for business operations
- Bygone Fisherman LLC (Bristol Maps) is not responsible for the accuracy, completeness, or timeliness of data provided by processors or tenders
- Bygone Fisherman LLC (Bristol Maps) is not responsible for business disputes, payment issues, or contractual matters between fishermen and processors/tenders
- You are responsible for verifying all processor-provided information including prices, weights, delivery requirements, and payment terms
- Processors and tenders use Bristol Maps subject to their own terms and privacy practices
The processor/tender integration is provided as a convenience and communication tool. All business transactions, agreements, and relationships between fishermen and processors/tenders are independent of Bristol Maps.
Fleet Location Sharing and Group Features
Fleet location sharing features allow you to:
- Share your real-time GPS position with group members
- View other group members' positions if they opt to share
- Control your own sharing preferences at any time
You acknowledge that:
- Location data shared with groups is visible to all group members
- Group administrators may see membership and activity
- You are responsible for managing your group memberships
- Location sharing requires ongoing consent and can be disabled anytime
Hardware Integration and Third-Party Devices
Bristol Maps may integrate with various marine electronics and hardware devices, including:
- NMEA GPS receivers
- AIS receivers
- Yacht Devices NMEA 2000 gateways
- Depth sounders and marine electronics
We are not responsible for:
- Hardware compatibility or malfunction
- Data accuracy from third-party devices
- Network connectivity issues
- Damage to devices from app usage
Regulatory Compliance
Bristol Maps displays fishing boundaries, statistical areas, and regulatory information for reference only. Users are solely responsible for:
- Verifying current regulations with Alaska Department of Fish & Game
- Ensuring compliance with all commercial fishing laws
- Maintaining required permits and licenses
- Accurate reporting of catches and deliveries
Boundary lines shown in the app may not reflect the most current regulations. Always verify boundaries through official sources.
Network Connectivity and Service Availability
Certain features require internet connectivity, including:
- Weather and tide data downloads
- Fleet location sharing
- AIS vessel tracking
- Fish ticket submission
- Map downloads
We do not guarantee:
- Continuous network availability in remote Alaska waters
- Real-time data delivery
- WebSocket connection stability
- Third-party API availability (weather, tides, etc.)
Artificial Intelligence and Analytics
Bristol Maps may use artificial intelligence (AI) and machine learning technologies to improve our services and user experience. You acknowledge and agree that:
- Some data may be shared with third-party AI tools and services for purposes of analytics, pattern recognition, and service improvement
- AI may be used to analyze usage patterns, detect anomalies, optimize features, and provide insights
- Data shared with AI services is processed in accordance with our Privacy Policy and applicable data protection laws
- AI-generated insights or recommendations are provided for informational purposes only and should not be relied upon for critical fishing, navigation, or safety decisions
- We implement appropriate safeguards to protect your data when using third-party AI services
User-Requested AI Analysis
Users may request AI-powered summaries, analytics, or insights based on their own personal fishing data, logs, and app usage. When you request such analysis:
- Your personal data will be processed by AI services to generate requested summaries or analytics
- We will anonymize your data as best as possible and feasible before processing
- The AI analysis is provided as a convenience feature and should not be used as the sole basis for fishing, business, or safety decisions
- You understand that complete anonymization may not always be possible while still providing meaningful personalized insights
AI-Generated Announcement Summaries
Bristol Maps may provide AI-generated summaries of announcements, regulatory updates, weather alerts, or other information. You acknowledge and agree that:
- AI-generated summaries may be inaccurate, incomplete, or misleading
- Summaries are provided for convenience only and may omit important details
- You are solely responsible for verifying all information in AI-generated summaries against original source documents
- AI summaries should never be relied upon for regulatory compliance, safety decisions, or critical fishing operations
- Always read the full original announcement or document before making decisions based on its content
- Bristol Maps and Bygone Fisherman LLC are not liable for errors, omissions, or misinterpretations in AI-generated summaries
Third-party AI services may include but are not limited to: natural language processing, data analytics platforms, error detection systems, and customer support tools. We retain control over what data is shared and ensure third-party providers comply with confidentiality and security requirements.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, BRISTOL MAPS AND BYGONE FISHERMAN LLC SHALL NOT BE LIABLE FOR:
- Any damages arising from navigation errors or inaccurate map data
- Losses resulting from reliance on weather, tide, or AIS data
- Business losses, lost catches, or fishing opportunity costs
- Damages from app downtime or service interruptions
- Any indirect, consequential, or incidental damages
- Errors, omissions, or inaccuracies in processor/tender data
- Disputes between users and processors/tenders
- Errors or inaccuracies in AI-generated insights, recommendations, or announcement summaries
- Damages resulting from reliance on AI-generated content without verification
Maximum Liability Cap
In no event shall the total aggregate liability of Bristol Maps and Bygone Fisherman LLC to you for all claims arising out of or related to your use of the app or services exceed the total amount paid by you to Bristol Maps for subscription fees in the twelve (12) months immediately preceding the event giving rise to the claim.
If you have not paid any subscription fees (for example, if you are using a free trial, promotional period, or unlock code), our maximum liability to you shall not exceed fifty dollars ($50.00 USD).
This limitation of liability applies regardless of the theory of liability, whether based on warranty, contract, statute, tort (including negligence), or otherwise, and whether or not Bristol Maps has been informed of the possibility of such damage.
Your use of Bristol Maps for commercial fishing operations is at your own risk.
Force Majeure
Bristol Maps and Bygone Fisherman LLC shall not be liable for any failure or delay in performance of our obligations under these Terms of Service when such failure or delay is due to circumstances beyond our reasonable control, including but not limited to:
- Acts of God, natural disasters, extreme weather events, or environmental catastrophes
- Satellite system failures or GPS signal degradation
- Undersea cable cuts or telecommunications infrastructure failures
- Solar flares, geomagnetic storms, or other space weather events affecting GPS or communications
- Internet backbone or cloud service provider outages
- Power outages or utility failures in remote Alaska locations
- Government actions, regulations, or restrictions
- War, terrorism, civil unrest, or similar events
- Cyberattacks, denial-of-service attacks, or other malicious activities
- Failures or outages of third-party services (AWS, weather APIs, NOAA systems, etc.)
During any Force Majeure event:
- We will make reasonable efforts to resume normal service as quickly as possible
- We are not required to provide refunds or credits for service interruptions
- Subscription periods may be extended at our discretion
- We will attempt to notify users through available channels when possible
Given the remote nature of Bristol Bay and Alaska waters, users acknowledge that connectivity and service availability may be affected by environmental and infrastructure challenges beyond our control.
Dispute Resolution and Arbitration
PLEASE READ THIS SECTION CAREFULLY. It affects your legal rights, including your right to file a lawsuit in court.
Informal Dispute Resolution
Before initiating arbitration or any legal proceeding, you agree to first contact us at support@bristolmaps.com to attempt to resolve the dispute informally. We will attempt to resolve the dispute informally by contacting you via email. If a dispute is not resolved within sixty (60) days of submission, you or Bristol Maps may initiate arbitration proceedings.
Binding Arbitration
If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms of Service or your use of Bristol Maps shall be settled by binding arbitration in accordance with the commercial arbitration rules of the American Arbitration Association (AAA).
The arbitration will be conducted in Washington State, or at another mutually agreed location. The arbitration shall be conducted by a single arbitrator, and judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction.
Exceptions to Arbitration
Notwithstanding the above, either party may seek equitable relief in court for infringement or other misuse of intellectual property rights (such as trademarks, trade dress, domain names, trade secrets, copyrights, or patents). Additionally, either party may bring claims in small claims court if the claims qualify and remain in small claims court.
Class Action Waiver
YOU AND BRISTOL MAPS AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.
Unless both you and Bristol Maps agree otherwise, the arbitrator may not consolidate more than one person's claims, and may not otherwise preside over any form of a representative or class proceeding. If this specific provision is found to be unenforceable, then the entirety of this arbitration provision shall be null and void.
Arbitration Costs
Payment of all filing, administration, and arbitrator fees will be governed by the AAA's rules. If your claim is for less than $10,000, we will reimburse you for your filing fees and will pay all administration and arbitrator fees, unless the arbitrator finds your claim frivolous.
Opt-Out Right
You have the right to opt out of this arbitration agreement. To opt out, you must notify us in writing within thirty (30) days of first accepting these Terms of Service. Your opt-out notice must include your name, email address, and a clear statement that you wish to opt out of this arbitration agreement. Send opt-out notices to: support@bristolmaps.com with subject line "Arbitration Opt-Out".
If you opt out of the arbitration agreement, all other parts of these Terms of Service will continue to apply. Opting out of this arbitration agreement has no effect on any other arbitration agreements that you may currently have or may enter into in the future with us.
Severability
If any portion of this Dispute Resolution and Arbitration section is found to be unenforceable or unlawful for any reason, the unenforceable or unlawful provision shall be severed from these Terms of Service, and severance of the unenforceable or unlawful provision shall have no impact whatsoever on the remainder of this section or the parties' ability to compel arbitration of any remaining claims on an individual basis.
Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to its conflict of law provisions. You irrevocably submit to the exclusive jurisdiction of the courts in that State or location, except as provided in the Dispute Resolution and Arbitration section above.
